Summary

Tariff surcharge disclosure would require sellers to show the part of a consumer price that comes from certain presidential tariffs. The Federal Trade Commission would oversee compliance and enforcement.

  • Consumers would see a separate line showing the tariff portion on eligible purchases. This applies to tariffs imposed on an emergency or discretionary basis by the President that entered into force on or after January 20, 2025.
  • Sellers who sell goods to U.S. consumers would need to clearly and conspicuously display the tariff surcharge for sales occurring 30 days after enactment.
  • Businesses that qualify as a small business concern under the Small Business Act would be exempt from the disclosure requirement.
  • The Federal Trade Commission would issue rules under the Administrative Procedure Act and enforce the rule using its existing authorities under the FTC Act, including penalties and related powers.
