Crypto bans and penalties for top officials
If enacted, top federal officials and some relatives would face strict limits on crypto. They could not use trusts, companies, wallets, or protocols to dodge the rules. They would be barred from roles with crypto issuers and from owning a share that allows unilateral token changes. They could not promote, market, mine, or trade crypto for pay, or trade while in office with secret information. SEC-reporting companies could not trade crypto for these officials, and violations could bring criminal charges under 18 U.S.C. 216.
Who is covered and what is crypto
If enacted, the bill would define who is a covered individual. That would include the President, Vice President, Members of Congress, and some relatives. It would define digital asset broadly. Examples include stablecoins, memecoins, NFTs, DAO tokens, DeFi staking or lending, and crypto-linked funds or derivatives. A beneficial owner would include anyone with 5% or more, or who controls or benefits through trusts or nominees. These definitions would decide who the other rules apply to.
