Sponsored By: Representative McClain Delaney, April [D-MD-6]

Introduced

Summary

Creates a $462.5 million emergency fund to keep food banks and the Emergency Food Assistance Program running when SNAP funding is insufficient or lapses. This bill would let USDA use a single appropriation to support EFAP during anticipated or actual SNAP shortfalls and treat the staff and contractors needed to run EFAP as exempt from furlough rules.

  • Families and households: Keeps emergency food access during periods when SNAP funds are short or delayed, reducing interruptions in food distributions.
  • Food banks and EFAP operators: Gain access to a $462.5 million appropriation, available until expended, to maintain commodity orders and distribution during funding gaps.
  • USDA staff and contractors: Services necessary to carry out EFAP would be deemed emergency services for purposes of the anti-furlough statute, so those roles would not be subject to furloughs during lapses.

*If enacted, this would increase federal spending by $462.5 million.*

Backup funds for food banks if SNAP stalls

If enacted, this bill would provide a one-time $462.5 million to the USDA’s emergency food program, available until spent. USDA could use it when regular SNAP funds are not enough to avoid benefit cuts or to pay full, on-time benefits. The money could be used during and after a government funding lapse to keep food moving to food banks. Staff and contractors who run this program would be treated as emergency workers, so they would not be furloughed. The bill would apply as if it started on September 30, 2025.
