- People who are LGBTQ, who are pregnant, or who have intersex traits gain explicit federal protection when they use public-facing businesses and services. The bill clarifies access to facilities consistent with a person's gender identity.
- A wider range of places count as public accommodations, including stores, online retailers, banks, salons, health-care providers, food banks, shelters, funeral parlors, and transportation services. More types of businesses and services must follow nondiscrimination rules.
- The measure provides detailed definitions for sex, sexual orientation, gender identity, and sex characteristics to guide enforcement and interpretation. It also says the Religious Freedom Restoration Act may not be used as a defense against these public-accommodation rules while preserving other civil-rights remedies.

Broader public-place nondiscrimination

It would also define sex to include sex stereotypes, sexual orientation, gender identity, pregnancy, and sex characteristics (including intersex traits). These changes would take effect upon enactment.
Access to restrooms by gender identity
If enacted, the bill would ban denying a person access to a shared facility that matches their gender identity. Covered shared facilities include restrooms, locker rooms, and dressing rooms. This requirement would take effect upon enactment.
Keep civil-rights lawsuits; bar religious defense
If enacted, the bill would say nothing in this title limits existing civil-rights claims or remedies. It would preserve suits under statutes such as 42 U.S.C. 1983 and 1985. It would also prevent the Religious Freedom Restoration Act from being used as a defense or basis to challenge enforcement of this title.
