- People with ACA Exchange coverage would count as eligible if their plan is a "qualified health plan" through an Exchange, allowing HSA contributions for months they are covered. This applies for tax years starting after Dec. 31, 2026.
- Employees in employer group health plans would also qualify when those plans meet the new "covered health plan" definition, widening eligibility beyond the current high-deductible requirement.
- The bill would amend multiple Internal Revenue Code sections to swap the phrase "high deductible health plan" with "covered health plan," changing the legal tests and references that determine HSA participation.

More people can use HSAs
This bill would let more people use Health Savings Accounts (HSAs). It would make you an HSA-eligible individual for a month if you are covered on the first day of that month by a "covered health plan." A "covered health plan" would include (A) qualified health plans sold through the ACA marketplace (Exchange) and (B) any group health plan. The bill would replace references to "high deductible health plan" with "covered health plan" across HSA tax rules. If enacted, you would be able to make tax-preferred HSA contributions under the usual limits for tax years starting after December 31, 2026.
