- Families and infants: Would tighten safety oversight by requiring testing for listed pathogens, including Clostridium botulinum, in finished formula and in facility environments so contamination can be identified early.
- Manufacturers: Would update Good Manufacturing Practices to require facility and finished-product testing, including environmental checks in Zones 2 and 3, require written notification to the Secretary within one business day of any positive test, and require retention of those records. It would also set a 90-day deadline for final implementing regulations.
- Regulators and Congress: Would require the Secretary to develop a mandated list of pathogens and would direct the FDA Commissioner to adopt clear, consistent inspection and compliance standards for all infant formula. It would also require written notice to specified Congressional committees within one business day of a positive finished-product test or an 'official action indicated' inspection classification.

Stricter testing rules for baby formula
If enacted, the bill would require the HHS Secretary to issue final rules within 90 days to update good manufacturing practices for infant formula. The rules would require makers to test their facilities and finished formula for listed pathogens, including Clostridium botulinum, and to include environmental testing in facility Zones 2 and 3. The rules would require manufacturers to notify the Secretary in writing within one business day after any positive test on the required list and to keep records of any such positive test. The bill would also require FDA to notify certain Congressional committees in writing within one business day after a manufacturer's positive finished-product test notice or after an inspection that yields an 'official action indicated'. The named committees are House Appropriations, House Energy and Commerce, Senate Appropriations, and Senate Health, Education, Labor, and Pensions.
