CHARTER Act
Sponsored By: Representative DeLauro, Rosa L. [D-CT-3]
Introduced
Summary
Prevents for-profit companies from operating charter schools that receive federal K–12 funds. This bill would bar for-profit entities from operating, overseeing, managing, or administering charter schools that get money under the Elementary and Secondary Education Act (ESEA) and the Individuals with Disabilities Education Act (IDEA). It would align charter definitions across ESEA and IDEA and allow a narrow set of service contracts that do not involve school management.

- Families and students: Aims to keep federal ESEA and IDEA dollars in nonprofit-run schools, reducing the chance those funds are diverted to private profit.
- Charter schools and operators: Would ban contracts with for-profit companies to run or manage schools, including curriculum, budget, and staffing. It still permits limited frontline service contracts that do not involve administration or management.
- For-profit companies and charter management organizations: Would prevent for-profit CMOs or other for-profit entities from receiving revenue to extract profit from federally funded charters. The prohibition would apply to contracts entered into, renewed, or extended three years after enactment.

Ban for-profit management of charter schools
This bill would bar charter schools that get federal ESEA or IDEA funds from hiring for-profit companies to run, oversee, or manage the school. Prohibited tasks would include setting curriculum, managing budgets, and hiring, firing, or supervising school staff. It would still let charter schools hire for-profit or nonprofit vendors for limited services like food, payroll, facilities maintenance, transportation, classroom supplies, and other ancillary services. The bill would make ESEA and IDEA use the same definition of "charter school." This bill would take effect three years after enactment and would apply only to contracts entered into, renewed, or extended on or after that date.
