Summary
Stops automatic reclassification of a biologic as a "biological product" based only on a clinically inactive protein. The Protecting Equal Access to Thyroid Act of 2026 would amend section 351(i)(1) of the Public Health Service Act so that a biologic may not be treated as a biological product solely because it contains a protein that is a clinically inactive component. The bill also makes a minor technical punctuation correction to that statutory text.
