Summary

Permanent exclusion of fraud-convicted providers from Federal health care programs. This bill would amend Section 1128 of the Social Security Act to make providers convicted after enactment of fraud, theft, embezzlement, breach of fiduciary responsibility, or related financial misconduct permanently ineligible to participate in Federal health care programs. It also clarifies how this permanent exclusion interacts with existing exclusion rules under the same section.

Permanent exclusion for fraudulent providers

This bill would permanently bar a health care individual or entity from participating in Federal health care programs if the person or entity is convicted on or after the date of enactment of fraud, theft, embezzlement, breach of fiduciary responsibility, or other financial misconduct. The permanent exclusion would apply under current exclusion authorities and would remove eligibility to bill federal programs. The bill would also say that certain existing temporary-exclusion rules would not apply to these permanent, fraud-based exclusions. If enacted, this change would take effect upon enactment.
