Notice, pause, and reporting for big payments

If enacted, the Secretary of the Treasury would have to notify the House and Senate Judiciary Committees before approving any settlement or award over $250,000 or any payment tied to imminent litigation. Treasury could not make that payment for 120 days after the required notice is received. The Treasury would also have to report to Judiciary leaders within 30 days after any payment over $100,000 is made. These rules would apply to settlements or awards made on or after January 20, 2025.

Stop Treasury from funding presidential funds

If enacted, the bill would prevent the Secretary of the Treasury from creating or approving payments to compensation funds that are tied to a compromise settlement with the President or that would violate the section if paid from the Judgment Fund. The bill would specifically bar federal funds for the compensation fund created by the May 18, 2026 Trump v. IRS settlement. The bill would also confirm that Congress could still fund a prohibited payment by passing a specific appropriation for that claim. The Treasury restrictions would take effect upon enactment.

Who cannot get federal settlements

If enacted, the bill would bar taxpayer-funded settlements or awards to the President, Vice President, their close family, presidentially-owned entities, Cabinet members, senior White House staff paid at GS-15 or above, political appointees, and people who held those positions during the appointing President's term. It would also bar payments for claims tied to the January 6, 2021 attack, 2016 foreign election interference, and claims based on the same facts as a civil case dismissed with prejudice. The bill would apply the definition of 'political appointee' from 5 U.S.C. 9803 and set rules for what counts as a 'presidentially-owned entity.' These rules would apply to settlements or awards made on or after January 20, 2025.
