No American Left Behind Act

Sponsored By: Representative Hamadeh, Abraham J. [R-AZ-8]

Introduced

Summary

Recover, repatriate, and secure accountability for U.S. nationals held, missing, or killed abroad. This bill would require the Secretary of Defense to deliver a comprehensive, mostly unclassified report to the congressional defense committees within 180 days of enactment that maps DoD roles, operational criteria, legal and resource gaps, and lessons from past cases focused on Syria, Iraq, Afghanistan, and select areas of Africa.

  • Families: Creates a centralized federal review of cases involving deceased, unlawfully detained, missing, or unresolved U.S. nationals. The report must assess remains recovery and other steps relevant to families seeking answers.
  • DoD operations and planning: Requires analysis of how the Assistant Secretary of Defense for Special Operations and Low-Intensity Conflict and the Hostage Recovery Fusion Cell inform contingency and rescue planning. It asks for criteria for using military assets, how force posture changes affect intelligence access and detainee handling, and operational implications where the U.S. lacks a permanent presence.
  • Policy and Congress: Directs identification of statutory, policy, intelligence, or resource gaps and recommendations to address them. It also requires a feasibility and operational assessment of creating a formal "No American Left Behind" doctrine and how it would be integrated into planning and resource allocation.
