- Small businesses: Entities with fewer than 20 full-time equivalent employees, counting affiliates, could qualify for a waiver that can cover fees for up to 5 years and must meet Small Business Administration size and affiliation rules.
- Foreign government–owned establishments: An initial or annual registration fee for an establishment owned or operated by a foreign government would equal the regular fee multiplied by 8.
- Application and administration: An applicant must submit a recent federal income tax return or payroll register at least 60 days before the fee due date. The Secretary may not consider past payment history when deciding eligibility and waiver decisions are non-reviewable.

FDA fee waiver for small businesses
If enacted, your small business would be eligible for a waiver of the FDA annual establishment registration fee. To qualify, the establishment must have fewer than 20 full‑time equivalent employees, counting employees of all affiliates, using SBA size and affiliation rules (13 CFR 121.103 and 121.106). You would need to submit either your most recent federal income tax return or your most recent payroll register at least 60 days before the fee due date. If approved, the waiver would cover 100% of the fee for the first three years and 50% for the next two years. Entities organized under the laws of a foreign government would not be eligible. Waiver decisions would be non‑reviewable. The change would take effect 90 days after enactment.
Higher FDA fees for foreign governments
If enacted, an establishment owned or operated by an entity organized under the laws of a foreign government would pay eight times the base FDA registration fee for initial and annual registration. This would apply to any initial or annual registration covered by the fee rules. The change would take effect 90 days after enactment.
