Ban on foreign money for ballot measures
This bill would expand the federal ban on foreign money to include state and local ballot initiatives, referenda, and recall elections. It would also bar disbursements to political committees or their accounts that accept donations that do not meet the Act’s limits or reporting rules. The change would apply to people and entities making payments for those ballot measures and to committees that take noncompliant donations.
Ban on foreign-owned business donations
This bill would bar companies from giving money to U.S. federal, state, or local elections when foreign people outside the U.S. own or control them. A business would count as foreign if foreign owners hold 50% or more, a single foreign owner has 1% or more, or two or more foreign owners hold 5% or more in the aggregate. It would also cover any foreign ability to direct decisions about U.S. interests or election activity. The rule would take effect 180 days after the bill becomes law.
CEO certification and fund rules
This bill would require a company’s CEO (or top official) to file a perjury-bound certification with the FEC within 7 days after the company makes any political contribution, expenditure, or related disbursement. The company must give a copy of that certification to committees that get the money and to other recipients on request. Recipients could not use or pass on funds from a company that was required to certify unless they have the certification, keep the funds separate, record them, and ensure future uses comply; a good-faith reliance defense would remain. These rules would take effect 180 days after the bill becomes law.
New rules for corporate political funds
This bill would stop a corporation’s separate segregated fund (corporate PAC) from making contributions or spending in a year unless the fund files a yearly certification with the FEC. The certification must say that each manager is a U.S. citizen or lawful permanent resident, that no covered foreign national takes part in decisions, and that the fund does not solicit or accept recommendations from covered foreign nationals. Any corporate board member who is a covered foreign national would have to abstain from voting on PAC matters.
