Patent Clash: Probe Targets Infringing Imported Cargo Containers

Published Date: 1/27/2025

Notice

Summary

Two companies say some imported big containers called composite intermediate bulk containers are breaking their U.S. patents. They’ve asked the government to investigate and possibly block these imports or sales to protect their business. If the investigation moves fast, it could change who can sell these containers in the U.S. and might affect prices or availability soon.

Investigation Could Block Container Imports

A complaint was filed on December 5, 2024 (supplemented December 20, 2024) alleging that certain imported composite intermediate bulk containers infringe six U.S. patents (U.S. Patent Nos. 9,718,581; 8,708,150; 8,919,562; 8,567,626; 9,004,310; 8,276,299). The complainants asked the U.S. International Trade Commission to investigate and to issue a general exclusion order, or alternatively a limited exclusion order, and cease-and-desist orders that could stop the importation or sale of the specified containers into the United States.

Possibility of Supply or Price Effects

Because the complainants seek orders that could stop imports or in-country sales of the named composite intermediate bulk containers, the investigation could change who is allowed to sell these containers in the U.S. and might affect the availability or price of those containers.
