No More Automatic EAD Extensions

Starting October 30, 2025, if you file to renew your employment authorization document (EAD) on or after that date, you will not get an automatic extension of your work permission while USCIS processes your renewal. Previously eligible renewals could be automatically extended for up to 540 days; that automatic extension will not apply to renewal filings made on or after October 30, 2025.

Employers Must Reverify and May Terminate

Employers must reverify employees' work authorization when an EAD expires and must remove from payroll employees who cannot present unexpired acceptable evidence of work authorization. Employers who continue to employ people without valid authorization risk civil and criminal penalties under INA section 274A.

Some Extensions Remain Unchanged (e.g., TPS)

This rule does not change automatic EAD extensions that were provided before October 30, 2025, and does not affect automatic extensions required by law or by Federal Register notices (for example, Temporary Protected Status-related employment documentation).
