Nuclear Regs Get Expiration Dates in Bizarre 'Sunset Rule' Twist

Published Date: 1/8/2026

Rule

Summary

The Nuclear Regulatory Commission is setting a new rule that adds expiration dates to some of its regulations to keep things fresh and efficient, following a government order to cut unnecessary rules. This change affects anyone dealing with nuclear regulations and starts on January 8, 2026. One part about aircraft impact rules got pulled back, so it won’t expire yet, meaning no surprise costs or changes there—for now!

Some NRC Rules Will Expire Automatically

The Nuclear Regulatory Commission inserted conditional sunset (expiration) dates into certain NRC regulations in response to Executive Order 14270, with the rule becoming effective January 8, 2026. If you deal with NRC regulations (for example, as a licensee, contractor, or employee in the nuclear sector), some of the rules that apply to you will now include a conditional expiration date and may be reviewed or removed later.

Aircraft Impact Rule Removed From Sunset

The NRC withdrew the amendment that would have added a conditional sunset date to 10 CFR 50.150 ("Aircraft impact assessment"); that withdrawal (amendatory instruction 42 from the December 3, 2025 rulemaking) is effective January 8, 2026. This means the aircraft impact assessment provisions will not receive the conditional expiration date now and will be addressed later in a separate final rule.
