Wyoming assumes regulation of some source material

The NRC proposes to stop regulating source material recovered from mineral resources processed mainly for purposes other than their uranium or thorium content, and transfer that regulatory authority to the State of Wyoming. The State Governor certified this request on August 5, 2025, and the NRC says one current NRC licensee would be transferred to Wyoming if the amended Agreement is approved.

Your NRC license becomes a Wyoming license

After the amended Agreement's effective date, an active NRC license for materials covered by the Agreement will continue in effect as a State of Wyoming license until the license expires or is replaced by a State-issued license. The State provides for "timely renewal" when renewal is filed more than 30 days before expiration.

State inspection schedule and staffing levels

The State of Wyoming will staff the Source Material Program with the equivalent of 3 full-time professional/technical staff and has adopted an inspection schedule that is as frequent as, or more frequent than, the NRC's inspection schedule. The NRC staff found Wyoming's staff qualifications and experience meet NRC criteria.

Wyoming adopts NRC-compatible rules

Wyoming adopted by reference NRC regulations in 10 CFR parts 19, 20, 40, 61, 71, and 150 for the Source Material Rules and Regulations (Chapters 1-9), and the State is revising its source material regulations to address NRC comments with revisions expected to be finalized by the end of 2025. The State will not attempt to enforce matters reserved to the Commission.

NRC retains certain authorities and one license

The amended Agreement preserves NRC authority over many items (including byproduct categories, special nuclear material, exports/imports, certain disposals, and other specified activities) and expressly retains regulatory authority over American Nuclear Corporation License No. SUA-667 (Docket No. 040-04492).
