30-Day Eviction Notice Removed for Tenants

Effective February 25, 2026, the USDA Rural Housing Service is removing its regulation that required a minimum 30-day notice before starting eviction proceedings for nonpayment of rent in Section 515 and 514 multi-family housing direct properties. If you rent in these USDA multi-family properties, the Agency’s specific 30-day regulation no longer applies to eviction notices from the borrower or property manager.

Simpler Eviction Process for Property Owners

Effective February 25, 2026, borrowers and property managers of USDA Section 515 and 514 multi-family housing no longer must follow the Agency's regulatory requirement for a minimum 30-day notice before eviction for nonpayment of rent. This change removes that specific regulatory step from the borrower’s lease and termination requirements in 7 CFR part 3560.

CARES Act 30-Day Notice Still Applies

The final rule states the CARES Act requirement that landlords of certain covered dwellings provide at least 30 days' notice for nonpayment of rent remains in effect. Properties receiving assistance under Section 514, 515, or 516 are considered covered dwellings, so the CARES Act 30-day notice still applies regardless of whether the Agency's regulation includes the same wording.

Borrowers No Longer Must Share Emergency Funding Info

Effective February 25, 2026, borrowers are no longer required by RHS regulation to disseminate information about Federal emergency funding to tenants during a Presidentially declared national emergency. The rule removes borrower obligations in the tenant grievance and termination provisions of 7 CFR part 3560.

USDA Will Notify Tenants About Emergency Funds

Effective February 25, 2026, the Rural Housing Service will distribute information to tenants about Federal funding during a Presidentially declared national emergency instead of requiring borrowers to do so. If you rent in USDA multi-family housing, the Agency says it will handle those notifications when required.
