Local Agencies Can Require Work

You could be required to do paid or approved unpaid work as a condition of keeping HUD rental assistance if your local Public Housing Agency (PHA) or certain project owners adopts a policy. The proposed rule would let PHAs and eligible Owners set work requirements for assisted adults, up to 40 hours per week, for people living in public housing or receiving HCV, PBV, or PBRA assistance.

Time Limits on Assistance Allowed

Your local PHA or an eligible Owner could place time limits on how long non-elderly, non-disabled families may receive HUD rental assistance. The proposed rule would permit term limits of no less than two years for non-elderly, non-disabled families in public housing, HCV, PBV, or PBRA programs.

Who Counts as Work‑Eligible Adults

The rule would define "work-eligible" adults as assisted family members aged 18 through 61 and would exclude persons with disabilities (as defined at 24 CFR 5.403), primary caretakers of such individuals, pregnant people, primary caretakers of a child under age 6, and students enrolled in higher education. PHAs and Owners could also set narrower local age limits (but not below 18 or above 61) or limit how long students are excluded.

Voucher Portability and Local Rules

If you hold a Housing Choice Voucher, any work requirement or term limit would apply only while you remain under the jurisdiction of a PHA that has adopted the policy; if you port to another PHA, you would follow the receiving PHA's work/term-limit policies. PHAs and Owners choosing to adopt policies must be well-performing (not in receivership or designated Troubled) and Owners must not be in default and must have a satisfactory review.
