EPA clears new chemicals to proceed

Between November 1, 2025 and December 31, 2025, EPA issued findings that some new chemical substances or significant new uses are "not likely to present an unreasonable risk" under TSCA. If you submitted a PMN, MCAN, or SNUN and received this finding, you may commence manufacture or processing despite any remaining portion of the review period.

90-day premanufacture notice rule applies

Under TSCA, anyone planning to manufacture (including import) a new chemical substance for non-exempt commercial purposes, or to engage in a use designated as a significant new use, must submit a notice to EPA at least 90 days before starting manufacture or that significant new use. This notice reiterates that 90-day timing requirement for potential manufacturers and processors.

Two biotech submissions listed as cleared

EPA listed two specific TSCA case numbers found "not likely to present an unreasonable risk" during November–December 2025: J-25-0011 (Escherichia coli, gene edited, containing 8 integrated genes) and J-25-0015 (genetically engineered yeast producing a chemical substance). Companies tied to those case numbers can consult EPA decision documents and may proceed as allowed by the findings.
