Required Crop Insurance for 2 Years

If you received an ERP 2022 payment, you must purchase crop insurance or Noninsured Crop Disaster Assistance Program (NAP) coverage for the next 2 available years. FSA will check RMA and FSA records to verify compliance; if FSA cannot verify with those records, you will be mailed a notice and must submit supporting documents to keep your payment.

De Minimis Rule Lets Some Keep Payments

Producers who received an ERP 2022 payment may be allowed to keep payments up to 90 percent of their revenue losses if the Secretary determines a de minimis amount of loss was due to uninsured or uncovered crops. Affected producers will receive a notification letter and must submit form FSA-524C, De Minimis Revenue Loss Certification for Uninsured/Uncovered Crops, to their FSA county office to claim this.

Responsibility to Repay Overpayments

If FSA determines a producer falsely certified that all eligible crops were insured or covered by NAP, the producer must refund any overpayment that resulted from using a 90 percent factor instead of 70 percent when their Track 2 payment was calculated. This refund obligation applies to producers whose original certification is found to be false.

Paperwork and Time Burden for Producers

FSA estimates this information collection will involve about 192,000 producers, 218,640 total annual responses, an average of 0.101375137 hours (about 6.1 minutes) per response, and a total annual burden of 22,165 hours. Producers who cannot be verified with agency data may receive a letter and need to submit supporting documents.
