Final Agency Determinations Bind Only Requestors

Starting May 1, 2026, final agency determinations (FADs) issued by the Federal Crop Insurance Corporation apply only to the party that requested the determination and are not binding on other program participants, judges, mediators, arbitrators, or the National Appeals Division.

90-Day Response Rule and Retroactive Requests

FCIC will issue a final agency determination within 90 days of receipt of a proper request; if FCIC does not respond within 90 days, the requested interpretation is applicable for the applicable crop year. Requestors may seek determinations for the crop year in which they request and for the three immediately preceding crop years.

Older Final Determinations Lose Broad Binding Effect

Final agency determinations issued prior to April 1, 2026 are not binding on any party other than the party that requested the determination unless that determination was incorporated by reference in a policy that was in effect on the date of publication of this final rule.

Policy Terms Removed From CFR; Published Online

Effective May 1, 2026, detailed Federal crop insurance policy provisions are removed from the Code of Federal Regulations and will instead be published through official program materials and made available on the Risk Management Agency (RMA) website; the rule states this does not change FCIC's statutory authority or the availability of crop insurance coverage.

FCIC Will Not Decide Fact-Specific Requests

FCIC will not provide a final agency determination for requests that contain specific factual information, acts, failures to act, examples, or hypotheticals; such requests will be returned without consideration, and FCIC will provide examples itself if needed to illustrate an interpretation.
