  • Child care providers, including family and group day care homes. The bill would permanently bar a provider after a "final determination of fraud" for knowingly submitting false documents, misrepresenting ownership, enrollment, attendance, or services, operating without required State licensing, knowingly and improperly spending funds, or other conduct that constitutes fraud under Federal or State law.
  • Child and Adult Care Food Program institutions and day care homes. Providers debarred under one program would also be permanently barred from participating in the other program, creating cross-program enforcement.
  • Federal enforcement and consistency. The bill would require the relevant Secretary to investigate alleged fraud and apply a consistent "final determination of fraud" standard that requires appeals or review rights to be exhausted or waived.

Permanent debarment for child care providers

If enacted, the bill would require the Secretary to investigate suspected fraud in federal child-care assistance. Providers with a final fraud finding would be permanently barred from receiving Child Care and Development Block Grant money. The bill would also permanently bar providers from the Child and Adult Care Food Program after a final fraud finding or if debarred under CCDBG. Covered fraud would include knowingly submitting false statements or documents; misrepresenting ownership, enrollment, attendance, services, or eligibility; operating without required State licensing without an exception; knowingly misusing program funds; or other Federal or State fraud. This would take effect upon enactment and could cut off major income for affected small child-care providers.
