Alaskans regain dividends after convictions are overturned

Alaska residents can recover Permanent Fund Dividends for years they were denied solely because of a conviction later vacated or reversed. The charges must then be dismissed outside a plea deal in another criminal case, or a retrial must end in acquittal. Applicants must file within two years after the dismissal or not-guilty finding. For qualifying events before the law’s effective date, the deadline is two years after that date. An earlier transfer of an equal amount to the restorative justice account does not block eligibility. The annual dividend calculation includes Permanent Fund income transfers and unused prior-year funds that return to the dividend fund. Before dividing the pool, the state deducts prior-year payments, including restored claims and timely applications omitted from earlier calculations. It also deducts program administration costs and payments that protect recipients from losing other benefits because of their dividends. The remaining pool is divided among eligible current-year recipients, including estates and successors where applicable.
