Commercial big-game guides need a permit to operate on state land in designated concession areas. The Department of Natural Resources awards full permits through open competition and limited permits through a random draw—not highest bids. Permits set hunting areas, client limits, and allowed species; limited permits have tighter limits. Each guide can hold up to three permits, lasting 10 years each, with no extension or renewal without new competition. The department sets qualifications, selection rules, and reasonable fees by regulation. Fees must consider guide fees elsewhere and the number and types of permits issued. Applicants' professional history and reputation count, and owners of at least 5,000 contiguous acres in the unit must be consulted. Transfers require commissioner approval, a qualified new holder, and review against program goals. The department enforces the program and can issue citations; permit violations can lead to suspension or loss after notice and a hearing. Information from the Big Game Commercial Services Board and confidential business information used in permit decisions must stay confidential.
Alaska's Board of Game must choose one game management unit or subunit that benefits most from the new guide-area program. It must take public comment and consult state agencies before choosing the first area and setting permit numbers and permissions. Natural Resources must start the first area's permit program, even before the usual approval process. The board cannot accept or consider proposals for more areas until the first area is established and its program has run for at least three years. After that, anyone can propose an area within one game management unit or subunit. The board must give 15 days' public notice before considering it at the next regular meeting in the region. It must take public comment, consult wildlife, land, and guide regulators, and find conservation, enforcement, and public-interest benefits. An area can combine no more than three existing guide use areas; each guide use area can contain only one concession area. The law repeals AS 08.54.600(a)(9), AS 16.05.262, AS 38.05.022, and sections 46 and 48 of chapter 15, SLA 2024. The act takes effect immediately and applies retroactively to July 23, 2024.
