Rural providers can collaborate under state oversight

Effective immediately, the law allows certified rural Alabama health care groups to share data, purchasing, staffing, technology, and services. Applicants must describe their partners, planned work, and expected effects on competition, and certify good faith and need. The State Health Planning and Development Agency must find that benefits outweigh likely harm to competition. Certificates require written approval from the Governor or a designee, who can impose conditions. Certificates last three years and can be renewed for three-year periods with evidence of continued need and benefits. Approved, actively supervised work receives protection from Alabama antitrust law and federal protection only as federal law allows. The agency cannot approve joint negotiations with health insurers, health benefit plans, employee welfare plans, covered government health plans, or their administrators. The agency must set oversight rules and change or cancel certificates when the work no longer meets the law’s standards. Household effects depend on which collaborations receive approval; the law does not guarantee lower prices or better access.
