Shooting event hosts gain limited lawsuit protection
Arkansas law protects qualifying hosts from liability for participant injuries or deaths caused by the built-in risks of shooting sports. Covered events include those sponsored by the Arkansas State Game and Fish Commission, Arkansas Game and Fish Foundation, or Arkansas 4-H Foundation, Incorporated. Coverage also includes owners or people controlling property who allow its free use for participation or practice by these organizations’ registered teams. Protection does not apply when a host supplies faulty equipment that causes injury or death and knew or should have known about the fault. Hosts supplying equipment also lose protection for failing to make reasonable checks of participants’ ability to participate safely or safely handle that equipment based on their stated ability. Another exception covers hidden dangers at facilities the host lawfully possesses and controls. It applies when the host knew or should have known about the danger, it caused injury or death, and clear warning signs were missing. Protection also excludes intentional harm, willful or wanton disregard for safety causing injury or death, and claims under product liability laws. Hosts must post and maintain clearly visible signs with black letters at least one inch high. The required notice reads: “WARNING Under Arkansas law, a host of a shooting sports event is not liable for an injury to or the death of a participant in a shooting sports event resulting from the inherent risk of shooting sports events.”
