Disability reviews guide student removal decisions

For students covered by the Individuals with Disabilities Education Act or Section 504, the required conference also reviews whether disability caused the behavior. When violent or abusive behavior is linked to the disability, the student must enter an interim district learning setting for no more than 10 days. The review team decides the next steps, and district discipline rules still apply during that period. When the district, targeted teacher, family, and relevant education-plan team members determine a placement change is needed, the review must consider the student’s file, education plan, teacher observations, and family information. A removal involving violent behavior may also require a behavioral threat assessment.

New classroom removal rules for students

Arkansas public school teachers can remove students for documented, repeated interference or unruly, disruptive, violent, or abusive behavior that seriously disrupts learning. Teachers do not have to remove students for every unruly or disruptive incident. Principals can choose another classroom-like school setting, in-school suspension, return to class, or another action allowed by district rules and law. Before return to that teacher’s class, a conference must address causes and solutions, including after two removals within any nine-week grading period. Participants include the principal or designee, teacher, counselor, parent, guardian or acting parent, and student when appropriate; a parent’s absence does not stop action. These rules exclude Division of Youth Services facilities, their contracted facilities, and the Arkansas Correctional School District.

Students face separation after violent behavior

Violent or abusive behavior includes threats, harmful item-throwing, physical abuse, and other actions presenting physical danger. Students removed for such behavior against a teacher or student must enter an interim learning setting during the required review and conference. District discipline rules still apply, and students cleared to return cannot share a class with the targeted person. After three or more removals for violent or abusive behavior in one school year, students must receive interim placement for the rest of that year or discipline under district rules. The law separately defines an interim learning setting as lasting no more than 10 days, despite its rest-of-year placement language.
