Dialysis technicians gain care authority and exemptions

The law authorizes dialysis technicians to provide direct patient care and hemodialysis under an Arkansas-licensed registered nurse’s authority. This includes giving medicines and accessing and caring for central venous catheters. The nurse delegates tasks based on nursing judgment and the technician’s education, knowledge, training, and skills. The act does not require technicians to register separately as medication assistive persons. The act’s requirements do not apply to technicians working directly with a physician licensed by the Arkansas State Medical Board.

New registration rules for Arkansas dialysis technicians

The law creates registration rules and a registry for dialysis patient care technicians under the Arkansas State Board of Nursing. Applicants need a high school diploma or GED and must meet one of three work or training paths. They must already work as a technician, attend nationally recommended training mainly at work, or have completed nationally recommended training. Completed training requires proof of skills and a skills checklist signed by the employing facility’s medical director. Applicants must apply and pay a fee set by the Board; the law gives no dollar amount. They must pass a national certification exam within 18 months of starting employment. Recertification follows the certifying organization’s schedule and requires 30–40 patient-contact hours since the last certification or recertification. Applicants must report felony and misdemeanor convictions in writing, but only offenses listed in § 17-3-102 can disqualify them. Applicants can report pardons or convictions that were set aside; those convictions cannot remain on the registry. The registry includes names, reported convictions, and certificates documenting nationally recognized training and a nationally available commercial certification exam. Listings remain valid during registration and renewal unless renewal is refused or the listing is removed. The Board can refuse or revoke registration for employment disqualification under § 20-33-213. It can also suspend, revoke, deny, or refuse to renew registration for fraud, unethical or unprofessional conduct, serious lack of knowledge or poor performance, false names, violations of the act, or unmet registration requirements. Disciplinary proceedings follow the Arkansas Administrative Procedure Act. Technician registration ends when the person becomes a licensed registered nurse or licensed practical nurse.
