More privacy protections for mortgage applicants

Arkansas law bars misleading or deceptive use of mortgage trigger leads—sales leads generated by credit-report inquiries after credit applications. The first contact must name the loan officer and the mortgage broker or banker they represent, and explain how they got your contact information. It must explain that your personal information was purchased from a credit reporting agency without your original lender's or broker's knowledge or permission. It must also state that the sender is not affiliated with your original creditor and is seeking new business. The message must include a firm offer of credit. Those using these leads cannot contact people who opted out of prescreened credit offers or call people on the National Do-Not-Call Registry. They also cannot knowingly use lead information in violation of these rules or the federal Fair Credit Reporting Act. Reports obtained by a lender that holds or services your existing debt are excluded from the trigger-lead definition. The law uses the relevant federal definitions, credit-offer standards, and registry rules as they existed on January 1, 2025.
