Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 0 costs, 2 mixed.

Public workers’ pension pay expands with caps

The law counts more types of pay toward Arkansas Public Employees’ Retirement System (APERS) benefits. These include career service recognition payments (§ 21-5-106) and payments under § 21-5-1101, including lump sums. It also includes lump sums under §§ 21-5-211 and 21-5-227, and bonuses under § 21-5-228. County payments under § 14-14-1206(a) and municipal budget bonuses under § 14-42-308 also count, with final-year limits. The final-year amount counted for these bonuses or lump sums cannot exceed the smaller of 5% of current-year salary or the prior-year payment.

Retirees face payment limits, keep retirement choices

Arkansas Public Employees’ Retirement System retirees cannot start pension payments until all employment-termination requirements are satisfied. Members and former members who fail those requirements forfeit benefits until they satisfy them. That failure does not cancel a member’s retirement election. The law repeals the separate provisions on payment timing and retirement elections and places these rules together in § 24-4-520(d).
