Arkansas petition sponsors face tighter rules

Arkansas’s Attorney General must review ballot titles and popular names for conflicts with the U.S. Constitution or federal laws. The Attorney General can reject the entire title, name, and petition for misleading voters or conflicting with federal law. Sponsors must redesign rejected titles and names to address these problems. The law also bars initiative and referendum petitions that conflict with the U.S. Constitution or federal laws. Sponsors cannot submit multiple conflicting petitions for review. Measures conflict when they share the same subject and general purpose but differ anywhere in their texts, titles, or names. Sponsors can submit conflicting petitions after a conflicting measure is rejected or after the next general election following its certification. The Attorney General must reject all petitions submitted in violation of this restriction. If a court invalidates one part of the law, the remaining parts stay in effect.
