Arkansas replaces the fixed $7,500 petroleum tank cleanup deductible with amounts set by state rules, capped at $30,000. The Petroleum Storage Tank Trust Fund cannot pay until the owner or operator spends the deductible for that cleanup. Underground tank owners and operators must show they can cover it; the spending requirement has an exception for emergency action by the environmental director. The law replaces payment denial for failing to report a leak with rule-based deductible requirements. The Division of Environmental Quality sets deductible amounts by rule, with input from the Advisory Committee on Petroleum Storage Tanks. The Arkansas Pollution Control and Ecology Commission must set deductibles above $7,500, but no higher than $30,000, for rule violations found when payment is requested. Those rules also require advisory committee input and can set different deductibles for different violations.
