Adoption residency rules with exceptions for families

Arkansas law generally requires children outside Department of Human Services custody to live in the adoptive home for at least six months. Until then, courts cannot issue a final adoption order or let an interim adoption order become final. The six months run from placement by a licensed child placement agency or filing of the adoption petition. This rule does not apply to the petitioner's stepchild or a child under six months old when the petition is filed. For children in department custody, the six-month home stay is not required for children under six months old. It also is not required when a child must live elsewhere for medically necessary health care. The Division of Children and Family Services director may waive it for children in department custody who are at least 16 and participating in a life skills, technical, or vocational program.
