Arkansas public charities face tighter investment rules

The law limits investment decisions by Arkansas government institutions holding funds only for charity, including state-supported two-year and four-year colleges. They cannot base investments, financial provider choices, or shareholder votes on specified nonfinancial policy goals. These include environmental and social goals, abortion or gender reassignment, firearm access, reducing businesses, and international agreements. Institutions also cannot direct or allow providers to advance those goals beyond what controlling law requires. If compliance requires a provider that materially harms a fund’s financial results, the institution can use a limited exception. It must choose the provider closest to meeting the rules without that harm. It must document comparisons with at least three alternatives, post required procurement-related notices, and review its decision at least yearly. Financial harm counts investment returns and fund-paid costs, but excludes government administrative costs paid outside the fund. The restrictions do not cover special gifts with contrary donor instructions in gift documents before January 1, 2024.
