Arkansas Human Services can issue rules for certifying nonhospital crisis stabilization units. It cannot adopt rules limiting use of crisis units without working with the Insurance Commissioner. Health plans’ care-management limits for crisis units must match or be consistent with Medicaid limits. The Insurance Commissioner can authorize limits by rule and issue rules to carry out the law. Plans cannot require advance approval for crisis unit care unless the commissioner authorizes it by rule. These rules cover individual and group health plans, including nonfederal self-funded government plans and Medicaid managed or reimbursed by insurers. They exclude workers’ compensation and plans offering only dental or vision benefits. The law does not guarantee that a person qualifies for or receives services.
Arkansas now recognizes crisis stabilization units as healthcare providers under its patient protection and provider choice laws. This brings the units under those laws’ provider protections and participation rules. These changes do not set new patient costs or guarantee coverage or access.
