Teacher retirement payments gain special-needs trust option

Beginning July 1, 2026, certain Arkansas Teacher Retirement System payments can go to a beneficiary’s special needs trust. For benefits under Arkansas Code §§ 24-7-706, 24-7-709, 24-7-711, and 24-7-720, the member naming the beneficiary can choose this option. The beneficiary’s parent or legal guardian can also choose it. For annuities under § 24-7-710, the eligible person’s parent or legal guardian makes the choice. The trust must be established for the person under 42 U.S.C. § 1396p(d)(4)(A) or (C), as of January 1, 2025. The system pays the person directly if no qualifying trust exists, the system cannot identify it, or it has ended. Payments can later go to a newly established trust once it is identified and an authorized person chooses that option. The law does not change payment amounts. The system need not create a trust, serve as trustee, or check its compliance with state or federal law. Its board can issue rules to carry out this payment option.
