Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 1 costs, 0 mixed.

Early discharge for offenses committed as minors

The Post-Prison Transfer Board may end parole or post-release supervision early for people who committed their offense as minors. They must have been released under the chapter’s rules for a supervision term longer than five years. They must serve at least five years on supervision without a violation. The prosecutor in the county of the original conviction must agree to discharge. Discharge restores voting rights, except as Arkansas Constitution Amendment 51 otherwise provides.

Jail sanctions trigger supervision revocation recommendations

For people on post-release supervision, accumulated jail or prison time imposed as an intermediate sanction triggers a required revocation recommendation. A community supervision officer must recommend revocation after more than 30 days in a county or regional jail. The same requirement applies after more than 360 days in a Division of Correction or Division of Community Correction facility. These thresholds require a recommendation, not automatic revocation.

Public app tracks parole and release details

The Post-Prison Transfer Board must run the public Safe Arkansas App to the extent federal law allows. It covers inmates being considered for parole or post-release supervision and people already serving either type of supervision. Records include names, correction identification numbers, current photos, offenses, sentences, sentencing dates, and sentence lengths. Inmate records include release eligibility dates; supervision records include release dates, time served, approximate sentence percentages served, and later charges. The Board must keep information current and may remove records when supervision ends.
