Brine operators gain options to reshape units

Arkansas brine operators can ask the commission to remove connected tracts of land from production or expansion units. Removal requires no unplugged brine production or disposal wells on the land. No such wells can have been within one-half mile of any outer boundary during the unit’s operation. Operations in the original or any adjacent unit must not drain the removed land or create an imminent drainage risk. Operators can also seek transfers of connected tracts between adjacent production or expansion units. The commission must approve transfers when all these requirements are met: the operator holds brine production rights covering at least 75% of each adjacent unit; the transfer expands, improves, or makes the receiving operation more efficient; and the transferred land will be drained efficiently. Transfers must not reduce owners’ royalty amounts or how long payments are reasonably expected to last. They also must not substantially harm rights to a fair share of brine for owners of transferred or receiving-unit land. Approved transferred tracts become a brine expansion unit next to the receiving unit.
