Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 0 costs, 2 mixed.

New limits on sharing provider networks

Arkansas generally bars contracting entities from leasing, renting, selling, or letting another contracting entity, insurer, or administrator use provider contracts or networks. An exception requires advance notice, contact details for the insurer or administrator, and provider opt-out rights. Providers must have opt-out opportunities at contract signing or renewal and after notice that an individual entity violated the contract. The opt-out requirement does not apply to access by affiliates or entities in the same brand licensee program. Dental-only plans also have an exception for sharing with affiliates or entities in the same brand licensee program. Violations are unfair trade practices subject to the Trade Practices Act, and a healthcare contract containing a violating provision is void.

Stronger provider protections, broader insurer duties

Arkansas expands its healthcare contracting rules to cover regulated entities that administer health insurance, including administrators for self-insured plans. Contracting entities cannot offer, enter, amend, or renew provider contracts containing an all-products clause. They also cannot enforce policies that work like such a clause, even when it is absent from the contract. Existing exceptions in Arkansas Code § 23-99-1203(b) and (d) still apply. Covered entities cannot waive these legal protections by contract; conflicting arrangements or actions have no legal effect.
