Bill Overview

Analyzed Economic Effects

5 provisions identified: 5 benefits, 0 costs, 0 mixed.

More time for childbirth injury claims

A child or representative has until the child's fifth birthday to file a claim for medical injury during childbirth. The law also sets deadlines for other medical malpractice claims involving minors. For injuries at age nine or younger, the deadline is the later of the 11th birthday or two years after the event. For injuries not known or reasonably discoverable before age 11, the deadline is two years after discovery or reasonable discovery, or the 19th birthday, whichever comes first. These filing rules do not guarantee compensation or a successful claim.

Faster Medicaid access during pregnancy

The law requires Arkansas Medicaid to determine temporary eligibility for pregnant applicants while their full applications are pending. This lets eligible applicants start covered prenatal care sooner. Medicaid may name qualified organizations to screen applicants and enroll them right away. Arkansas Medicaid and the Department of Human Services must seek needed federal approvals, and the department must adopt rules.

Medicaid covers ultrasounds away from providers

Arkansas Medicaid pays for medically necessary remote ultrasounds in both fee-for-service and managed care. Patients must be at home or another location away from the provider, with the same standard of care. Procedures must use established medical billing codes for remote ultrasounds. The technology must securely collect and send health data to a provider elsewhere for interpretation and care recommendations. It must have Food and Drug Administration approval and follow federal health privacy rules as they existed on January 1, 2025.

More Medicaid maternity care at home

Arkansas Medicaid covers home blood pressure monitoring for pregnant and postpartum members. Devices and replacement cuffs must be medically needed to diagnose or treat high blood pressure. Devices must be tested for clinical accuracy. Coverage includes setup and use training, plus collecting and sending readings to a healthcare provider for care decisions. Medicaid also pays doulas and community health workers for home visits related to prenatal or postpartum care.

Separate Medicaid payments for maternity care

Arkansas Medicaid must pay separately for prenatal, delivery, and postpartum services instead of using one bundled maternity payment. Services include office visits, lab fees, doctor-ordered tests and blood work, remote monitoring, and fetal nonstress tests. They also include medically necessary continuous glucose monitors and other care for diabetes during pregnancy. The law also requires Medicaid payment for depression screening during pregnancy. These changes are not intended to alter coverage through Arkansas Health and Opportunity for Me or specified risk-based provider organizations.
