Arkansas private care agencies need Department of Health licenses instead of Department of Human Services certification. These agencies provide in-home personal and attendant care for which they seek Medicaid payment. They must carry at least $1 million in liability insurance covering employees and independent contractors while providing care. Agencies must keep a primary Arkansas location serving administrative and patient needs, but regional offices are no longer required. The Department of Human Services can set Medicaid participation rules to ensure enough providers, including care availability 24 hours a day, seven days a week.
