Medical marijuana users face smoking limits

Arkansas law bans knowingly smoking or vaping medical marijuana in public places, on public transportation, and on school buses. Both are also banned at childcare centers, preschools, schools, colleges, universities, drug or alcohol treatment facilities, and community or recreation centers. The bans also cover correctional facilities and property controlled by the Arkansas National Guard or U.S. military. Smoking is also banned wherever tobacco smoking is prohibited and inside motor vehicles, aircraft, motorized boats, and other non-muscle-powered vehicles. You cannot knowingly smoke around anyone under 14 or a woman you know is pregnant. Smoking is also banned where it is likely to put someone not authorized to use marijuana under the influence. Violations are Class C misdemeanors.

Tighter rules for carrying medical marijuana

In Arkansas, smoking-ready medical marijuana within the seated driver's reach must be in a container obtained from a licensed dispensary. This applies to possession in a motor vehicle on a public highway or its right-of-way; containers include jars, bags, and wrapping. The law also bans knowingly transporting more than five ounces, except through authorized transporters or cultivation facility or dispensary employees. That exception requires licensed status for the transporter or facility and a valid Alcoholic Beverage Control Division registration identification card. Knowingly bringing medical marijuana from another state into Arkansas is also banned. Violating these possession or transport rules is a Class C misdemeanor.
