Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Care providers can use outside screeners

Arkansas care providers can use outside evaluation services to run state and national criminal-history checks. These services can decide whether applicants, employees, and contractors qualify to work under the law. Each service must be independent of both the provider and its licensing or certifying agency. It must be allowed to perform the checks under state and federal law, and follow confidentiality rules for reports.

Background checks now cover care contractors

Arkansas care providers must check independent contractors who provide care and have unsupervised access to clients. Providers must give advance notice that contracting depends on satisfactory results, and repeat checks at least every five years. After required registry checks, providers may allow conditional work while awaiting a decision. Covered contractors face the same disqualification rules, exceptions, and check-record requirements as employees. Clients' family members, volunteers, and administrative workers without unsupervised client access remain outside the covered employee definition.
