Analyzed Economic Effects

3 provisions identified: 2 benefits, 1 costs, 0 mixed.

Private clubs gain more drink-service options

Clubs with an Arkansas Alcoholic Beverage Control Board permit can serve beer, wine, and mixed drinks to members and guests on-site. Drinks can come from members’ private stocks or lawful purchases replenished at members’ expense; this service is not a sale. Clubs must use authorized suppliers: retailers or small breweries allowed under the club purchasing rules. Clubs can serve on their golf courses during professional or charitable tournaments after notifying the board at least 60 days ahead. Tournament attendees must be club guests. A new permit category covers nonprofit clubs at hotels or large-event facilities in counties without approved public liquor sales. These clubs must serve shared member purposes, not operate for profit.

Small breweries gain limited private-club sales

Permitted small breweries can sell their brewed drinks directly to private clubs in entertainment districts. The brewery and club must be in adjacent counties and have an exclusive agreement. Each brewery can have only one such club agreement at a time.

Private-club drink taxes cover more charges

The law extends supplemental taxes beyond club drinks drawn only from members’ private stocks. Covered charges for preparing and serving mixed drinks, or cooling and serving beer and wine, face a 10% tax. Covered mixed-drink charges face an extra 4%, for a combined 14%. These taxes apply to covered drink services for on-site consumption.
