Arkansas’s Department of Health runs kidney care assistance with advice from the new council. People with acute or chronic kidney failure can get help with dialysis or a transplant. Help may cover dental care needed for transplant consideration and copayments for medicines that prevent transplant rejection. For ongoing chronic kidney care assistance, patients must be unable to pay without severe hardship to themselves and immediate family. Eligibility rules must consider insurance coverage and the patient’s ability to pay. The Secretary of Health makes payments under State Board of Health rules and the Arkansas Administrative Procedure Act. A State Kidney Disease Escrow Account holds prior-year refunds and contributions to buy additional services for patients. The law sets no specific assistance amount or income cutoff.
A seven-member advisory council replaces Arkansas’s 10-member kidney disease commission. The State Board of Health appoints members for four-year terms. Four members must be Arkansas-licensed kidney doctors: three in private practice and one mainly in institutional practice. Another member must have hospital administration experience, and one must have a demonstrated interest in treating and curing kidney disease. The final member must be at least 60 and neither working nor retired from a field regulated by this law. The council chooses its officers, serves without pay, and may receive expense reimbursement. It meets at least annually; a majority of appointed members is needed to conduct business. Former commission terms ended on the law’s effective date, and former members may apply for the new council.
The Department of Health loses authority to accept private or federal gifts and donations for kidney treatment or donor recognition. It can still accept grants from those sources and support from city and county governments. The law does not specify a funding loss or change patient assistance amounts.
