Fewer dirtbike claims against private property owners

In Arkansas, people who rent, lease, or ride off-road motorcycles on private property assume the activity’s built-in risks, even without paying. Riders and their representatives cannot bring claims or recover from owners for resulting loss, damage, injury, or death. These risks include surface changes, rider errors, equipment failure caused by rider errors, animal attacks, and worsened conditions when remote medical care is unavailable. Protected owners include people or organizations that sponsor, organize, rent, or provide dirtbike use. Owners remain subject to liability for intentional harm, failure to use reasonable care, gross negligence, reckless misconduct, or criminal conduct. They also remain subject to liability for supplying a dirtbike they knew or should have known was unsafe. The law does not apply to employer–employee relationships covered by workers’ compensation.
