Arkansas law sets new steps for owners and renters who have the right to bring home defect claims. These steps cover defects found within one year after the home is completed, including claims handled through arbitration. Covered claims involve home improvement contractors, residential builders, or suppliers that make or provide windows or doors. A warranty defines the defect when one exists. Otherwise, defects include faulty materials, building code violations, or work below accepted construction standards. You must send detailed written notice at least 28 days before filing, describing the defect and its known results. The notice must request a written response within 14 days proposing an inspection, offering a remedy, or disputing the claim. An inspection proposal must include a time frame; afterward, the contractor can offer a remedy or dispute the claim. You can proceed without another notice if the claim is disputed, no timely response arrives, or you reject the offer. You can also proceed if an accepted remedy is not completed. To accept, respond in writing within 30 days after receiving the offer. You must allow reasonable access during normal working hours so the work can be completed by the offered timetable. Once the accepted remedy is completed, you cannot pursue that claim in court or arbitration. Before work starts, contractors and covered suppliers must give owners or renters written notice explaining these requirements. These steps do not apply to Arkansas Attorney General actions under the Deceptive Trade Practices Act.
