Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 2 costs, 0 mixed.

Roadwork vehicles can use green warning lights

Qualifying roadwork vehicles can use amber, white, or green flashing, rotating, or oscillating warning lights, alone or combined, during hazardous use. State, county, or city agencies must own or contract for the vehicle and determine it is needed for hazardous roadway service. Public service company or privately owned vehicles qualify when the Arkansas Office of Motor Vehicle approves their hazardous use under its rules. These vehicles must still obey traffic signals and speed limits; adding lights alone does not make a vehicle a roadwork vehicle. The legal definition of these warning lights now expressly includes roadwork lights and devices that imitate them.

Drivers face limits on colored warning lights

Drivers cannot display red, green, or amber flashing or rotating lights unless Arkansas law authorizes them. Attaching one of these lights to a vehicle counts as initial evidence that it was displayed. Purple lights are forbidden except during funeral processions. Front-facing red, blue, or green lights are generally banned, with exceptions for expressly authorized red lights and qualifying roadwork warning lights. Flashing lights are limited to authorized emergency vehicles, school buses, funeral processions, turn signals, hazard warnings, and qualifying roadwork vehicles.

Green lights alone confer no emergency status

Under the emergency-management rule, emergency vehicles must be identified by a green flashing light or rotating beacon. A roadwork vehicle using these lights does not automatically become an emergency vehicle. The Arkansas Division of Emergency Management director must designate it for that status. A separate rule requires other emergency-vehicle operators to use only white or amber emergency or warning lights, except police, fire services, and ambulances. Qualifying roadwork vehicles are also exempt from that color limit.
