Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

New privacy protections for gun owners

People and government bodies cannot knowingly keep, or arrange to keep, lists or records of privately owned guns or their owners. Owners and their representatives can keep lists of the owner's guns. Law enforcement can keep records of stolen or reported-stolen guns. Other records allowed by law remain permitted.

Arkansas gun retailers protected from payment coding

Payment networks cannot require store-category codes that single out Arkansas gun retailers. Covered banks, card companies, payment processors, and their agents cannot assign those codes to Arkansas gun retailers. Merchants cannot use code 5723 for purchases of guns, gun accessories or parts, or ammunition. The network rule does not cover electronic payments at stores outside Arkansas. Lawful dispute handling, fraud prevention, payment security, rewards programs, and actions required by law remain allowed.

State enforces gun privacy with limits

Only the Arkansas Attorney General enforces this law; it creates no right to bring a private lawsuit. The Attorney General can investigate independently or receive requests from affected gun retailers, their customers, or affected gun owners. Retailer requests must concern their own business; customer requests must concern a retailer where they did business. Owner requests must concern their own gun ownership. Retailers and customers must consent to sharing relevant financial records, or the Attorney General cannot pursue their requests. Within 45 days after finding a violation, the Attorney General must send written notice identifying the evidence. Recipients have 30 calendar days after receiving notice to show no violation and 60 calendar days to stop it. After that deadline, the Attorney General can seek a court order to stop violations. Knowingly disobeying that order can lead to civil penalties of up to $10,000 per violation. Being required to act by another applicable law is a defense.
